“How much will my case cost”?
The cost of your case will depend on how much litigation is necessary to bring resolution. The more you and your spouse can agree on, the less expensive your case will be. Uncontested cases can be billed at a “flat rate”, whereas contested cases are billed at an “hourly” rate. In no event are divorce attorneys in Illinois allowed to accept divorce cases on a “contingency” basis, which is when a lawyer’s fee is a percentage of the value of what you are awarded by the Court.
“How long will it take”?
An uncontested divorce can be finalized in as few as ten days, whereas a contested divorce can last many months, if not years. The reasonableness of the parties, and their attorneys, directly affects the length of time cases take, and how much the case ends up costing in legal fees. The more you and your spouse (or your lawyers) are able to communicate on a healthy and productive level, the more money you and your family will be able to preserve for yourselves and your children’s financial needs.
“Why should I hire you instead of the other guy, or why not just represent myself”?
It is certainly possible for someone to act “Pro-Se” in a divorce. However, there are specific rules and procedures of court that need to be followed.
