In a recent “Fox and Friends” television segment, a noted legal analyst stated that two groups of people are considered to be the most likely to avail themselves of pre-nuptial agreements: those who marry for the second time and those who marry later in life. Couples in Illinois and across the country might be interested to know that “prenups,” as they have become known, are considered a good idea. According to the analyst, the most importantContinue reading

Gay or lesbian marriages ending in divorce

On behalf of The Walters Law Group, Ltd. posted in Family Law on Monday, July 22, 2013. For many same-sex couples, being able to enter the civil institution of marriage is a long-awaited blessing. The District of Columbia, in conjunction with 12 other states, has lifted the ban on same-sex marriages resulting in tens of thousands of people obtaining marriage licenses. The transition, however, isn’t always easy. The stigma associated with the traditional roles played in a conventional marriage often don’t apply to same-sex couples. Their relationships are frequently created based onContinue reading

The proposal is centered on lessening the burden of permanent spousal support after separation of divorce. Several states have already adopted the reform, and it includes specific amount of money and length of support for the receiving spouse. The opponents of the new laws argue that the reform may adversely affect many women who may not have any other sources of income,Continue reading

A pre-marital agreement will protect assets if a divorce occurs

On behalf of The Walters Law Group, Ltd. posted in Divorce on Tuesday, June 11, 2013. When it comes to marriage in Illinois, many couples fail to discuss entering into a pre-marital agreement. In many instances, people believe that a prenuptial agreement is not needed as discussing such an agreement signals an uncertainty about the upcoming nuptials. No couple wants to discuss the possibility of a divorce before even walking down the aisle. Regardless of whether or not a couple feels that a prenuptial agreement applies to them, the fact remains that nearly halfContinue reading

Prenuptial agreements protect in the event of divorce

On behalf of The Walters Law Group, Ltd. posted in Divorce on Wednesday, June 5, 2013. Discussing prenups with a future spouse can be particularly difficult. A prenup is a contract that divides assets in the event of a divorce, and most couples simply do not want to converse with their loved one about what would happen if their marriage ended before they have even walked down the aisle. However, prenups are put in place to protect both spouses and specify how any and all assets will be divided down the road, mitigatingContinue reading

With the growing trend of women earning more income than their husbands, more women are being ordered to pay spousal support to their husbands in divorce cases. Alimony was once a means of providing economic and legal recognition for women, who mostly stayed out of the workforce. This allowed them to take care of the duties of running the household. In the event of a divorce, alimony acknowledged that the wife had sacrificed her earning powerContinue reading

Protecting financial assets when couples live together

On behalf of The Walters Law Group, Ltd. posted in Unmarried Couples on Wednesday, May 15, 2013. Statistics show that almost half of U.S. adults between the ages of 30 and 49 have lived together without the benefit of marriage. Marriage offers a number of benefits that living together does not. A break up is rarely easy, but when couples who are older separate, the problems are compounded, especially if they have additional assets. In some cases, the law doesn’t afford legal protections to unmarried people, especially in financial matters and inContinue reading
